SOL7002 International Commercial Litigation and Conflict of Laws
Module description
To develop students’ detailed, critical and advanced knowledge of the key procedural and substantive aspects of international dispute resolution, including jurisdiction, applicable law, and the recognition and enforcement of foreign judgments. To foster an in-depth understanding of the allocation of jurisdiction between national courts of different countries and between courts and arbitral tribunals, as well as the principles governing the choice of applicable law in commercial transactions. To enable students to apply strategic thinking and cross-cultural expertise by analyzing real-world case studies from both civil and common law systems. To equip students with the ability to design effective dispute resolution strategies, including drafting enforceable jurisdiction and choice-of-law clauses and evaluating the most suitable venues and legal frameworks for international commercial disputes.
